| Devendra Fadnavis Says Shiv Sena Has Shamed State, Allies Set for Separate Contest  MUMBAI: The dramatic events of Monday that led up to the launch of Pakistan Foreign Minister Khurshid Mahmud Kasuri's book in Mumbai, brought the tenuous ties between partners BJP and Shiv Sena in Maharashtra to a new low. The Shiv Sena has dismantled the alliance for important civic elections, expected to be held on November 1. The Sena will contest all 122 seats of the Kalyan-Dombivali municipal elections on its own. Kalyan and Dombivali are Mumbai's satellite cities with a municipal corporation currently run by the Sena-BJP alliance. Last night, Maharashtra Chief Minister Devendra Fadnavis had accused the Shiv Sena of bringing the state a bad name with its protest against the launch of Mr Kasuri's book, which included an attack with black paint on the event's organiser, former BJP adviser and columnist Sudheendra Kulkarni.
"We cannot endorse Mr Kasuri, but can't let our state turn into a banana republic," said the chief minister, who made unprecedented security arrangements for Mr Kasuri.
"We may not agree with views of somebody, but when a foreign dignitary or a diplomat arrives on a valid visa and holds a program which is not illegal, its the duty of a state to provide protection," Mr Fadnavis said. The Sena says it will oppose any engagement with Pakistan as long as it supports terror attacks on Indian soil. Last week, it forced the cancellation of famous Pakistani singer Ghulam Ali's concert in Mumbai, another episode that pitted it against Mr Fadnavis, who had said the ghazal singer was welcome to perform in the city. Despite the chief minister's promise to provide Ghulam Ali with "full protection," organisers of the concert called off the performance after meeting Sena chief Uddhav Thackeray. It underscored not just the disconnect between the two ruling allies, but also how things function on-round in Mumbai despite the BJP now leading the alliance in the state. Mr Kasuri made it to his book launch without incident or even encountering protests on Monday evening. Six Shiv Sena workers were arrested for the paint attack on Mr Kulkarni, described by Sena leader Aditya Thackeray as "non-violent". | |

| നിതി ആയോഗ് വന് ചതിയായി : ആകെ ആശയക്കുഴപ്പം, കേന്ദ്രാവിഷ്കൃത പദ്ധതികള് അവതാളത്തില്  തിരുവനന്തപുരം : ആസൂത്രണകമ്മിഷനു പകരം രൂപീകൃതമായ നിതി ആയോഗിലെ ആശയക്കുഴപ്പം മൂലം കേന്ദ്രാവിഷ്കൃതപദ്ധതികള് അവതാളത്തില്. ഏതൊക്കെ പദ്ധതികള് തുടരുമെന്നോ ഏതിനൊക്കെ സഹായം ലഭിക്കുമെന്നോ അറിയാതെ വലയുകയാണു കേരളം ഉള്പ്പെടെയുള്ള സംസ്ഥാനങ്ങള്. നിതി ആയോഗ് നിലവില്വന്നശേഷം കേന്ദ്രാവിഷ്കൃതപദ്ധതികള് പരിശോധിക്കാന് മുഖ്യമന്ത്രിമാരുടെ ഉപസമിതി രൂപീകരിച്ചെങ്കിലും യോഗം ചേര്ന്നിട്ടു നാലുമാസത്തിലേറെയായി. വ്യക്തമായ രൂപരേഖയാകാത്തതിനാല് പദ്ധതികള് ആവിഷ്കരിക്കാനാകാത്ത അവസ്ഥയിലാണു കേരളം. കേന്ദ്ര ഫണ്ട് ലഭിച്ചില്ലെങ്കിലും പദ്ധതികള്ക്കു സംസ്ഥാനവിഹിതം നല്കാന് ധനവകുപ്പ് നിര്ദേശിച്ചിട്ടുണ്ട്. എന്നാല് തുടര്പ്രവര്ത്തനം സംബന്ധിച്ച് ആശങ്ക ശക്തം. മേക്ക് ഇന് ഇന്ത്യയുള്പ്പെടെ പല പദ്ധതികളും നിതി ആയോഗിലെ ആശയക്കുഴപ്പം മൂലം തകിടംമറിയുന്നു. നരേന്ദ്ര മോഡി സര്ക്കാരിന്റെ ആദ്യപരിഷ്കാരമായ നിതി ആയോഗിന് ഉദ്ദേശ്യലക്ഷ്യങ്ങള് മുന്നോട്ടുകൊണ്ടുപോകാന് കഴിയാത്ത സ്ഥിതിയാണ്. നിതി ആയോഗിനു കീഴില് പ്രധാനമായും മൂന്നു സമിതികളാണു വിവിധ പദ്ധതികള് പരിശോധിക്കാന് രൂപീകരിച്ചത്. നൈപുണ്യവികസനം, സ്വച്ഛഭാരത്, കേന്ദ്രാവിഷ്കൃതപദ്ധതികള് എന്നിവയ്ക്കായി മൂന്നു മുഖ്യമന്ത്രിതലസമിതികള് രൂപീകരിച്ചു. മധ്യപ്രദേശ് മുഖ്യമന്ത്രി ശിവരാജ്സിങ് ചൗഹാന്റെ നേതൃത്വത്തിലാണു കേന്ദ്രാവിഷ്കൃതപദ്ധതികള് തീരുമാനിക്കുന്ന സമിതി. മുഖ്യമന്ത്രി ഉമ്മന് ചാണ്ടിയെക്കൂടാതെ രാജസ്ഥാന്, അരുണാചല്പ്രദേശ്, ജമ്മു കശ്മീര്, ഝാര്ഖണ്ഡ്, മണിപ്പുര്, നാഗാലാന്ഡ്, തെലങ്കാന, ഉത്തര്പ്രദേശ് മുഖ്യമന്ത്രിമാരും ആന്ഡമാന് നിക്കോബാര് ലെഫ്റ്റനന്റ് ഗവര്ണറും സമിതിയില് അംഗങ്ങളാണ്. നിലവിലുള്ള 72 കേന്ദ്രാവിഷ്കൃതപദ്ധതികള് മുപ്പതായി ചുരുക്കാന് സമിതി തീരുമാനിച്ചിരുന്നു. പദ്ധതികളെ കോര് എന്നും സാമൂഹികസുരക്ഷയെന്നും രണ്ടായി തിരിച്ചു. കോര് പദ്ധതികളില് വരുന്നതു ദേശീയവികസനപദ്ധതികളാണ്. തൊഴിലുറപ്പ്, സ്വച്ഛഭാരത്, ഉച്ചഭക്ഷണപദ്ധതി തുടങ്ങിയവ ഇതിലുള്പ്പെടും. കോര് പദ്ധതികളില് പലതരം ഫണ്ടിങ്ങിനെക്കുറിച്ചു പറയുന്നുണ്ടെങ്കിലും തീരുമാനമായിട്ടില്ല. തീരുമാനമെടുക്കാന് കഴിഞ്ഞ ജൂലൈ 13-നു ചേരാനിരുന്ന യോഗം നടന്നില്ല. കരടുരൂപരേഖയ്ക്കു കേരളം അഭിപ്രായങ്ങള് സമര്പ്പിച്ചിരുന്നു. ദേശീയ കൃഷി വികാസ് യോജനപോലുള്ള പദ്ധതികളില് ചീഫ് സെക്രട്ടറിമാരും നിതി ആയോഗ് പ്രതിനിധികളും ഉള്പ്പെടുന്ന സമിതിയുണ്ടാക്കണമെന്നും സംസ്ഥാനങ്ങള് തയാറാക്കി നല്കുന്ന പദ്ധതികള് പരിശോധിച്ചു ധനസഹായം തീരുമാനിക്കണമെന്നുമുള്ള നിര്ദേശം ഇതില്പ്പെടും. എന്നാല് ഉപസമിതിപോലും ചേരാന് കഴിയാത്ത സാഹചര്യത്തില് പദ്ധതികള് ത്രിശങ്കുവിലാണ്. കേരളത്തിന് 20,000 കോടിയിലേറെ രൂപയുടെ വാര്ഷികപദ്ധതിയാണുള്ളത്. 7000 കോടിയോളം രൂപയുടെ കേന്ദ്രാവിഷ്കൃതപദ്ധതികളുമുണ്ട്. കേന്ദ്രാവിഷ്കൃതപദ്ധതികളോടു കേരളത്തിനു പൂര്ണതാല്പര്യമില്ലെങ്കിലും തൊഴിലുറപ്പ്, അംഗന്വാടികളുടെ നടത്തിപ്പ്, ദാരിദ്ര്യനിര്മാര്ജനം തുടങ്ങി നിരവധി പദ്ധതികള് കേരളം ഫലപ്രദമായി ഉപയോഗിക്കുന്നുണ്ട്. മുന് ധനകാര്യ കമ്മിഷന്റെ റിപ്പോര്ട്ട് പുറത്തുവന്നപ്പോഴേ കേന്ദ്രാവിഷ്കൃതപദ്ധതികള് ഇല്ലാതാകുമെന്ന ഭീഷണിയുണ്ടായിരുന്നു. ഇവയ്ക്കുള്ള ഫണ്ടും സംസ്ഥാനവിഹിതത്തില് ലയിപ്പിക്കുകയായിരുന്നു. അന്നുയര്ന്ന ആശങ്ക നിതി ആയോഗ് വന്നതോടെ ശക്തമായി. പദ്ധതികള് തീരുമാനിക്കാന് മുഖ്യമന്ത്രിമാരുടെ ഉപസമിതി രൂപീകരിച്ചതായിരുന്നു ഏകആശ്വാസം. കഴിഞ്ഞ ജൂണില് റിപ്പോര്ട്ട് സമര്പ്പിക്കുമെന്നാണു പറഞ്ഞിരുന്നതെങ്കിലും അതു നടക്കാത്തതുകൊണ്ട് ആശയക്കുഴപ്പത്തിലാണു കേരളം. കേന്ദ്രാവിഷ്കൃതപദ്ധതികള് രൂപീകരിക്കാനുള്ള സമിതി മൂന്നുതവണ കൂടിയെങ്കിലും സ്വച്ഛഭാരത്, നൈപുണ്യവികസനസമിതികള് ചേര്ന്നിട്ടില്ല. നൈപുണ്യവികസനസമിതി ചേര്ന്ന് നയം രൂപീകരിക്കാത്തതിനാല് മോഡിയുടെ സ്വപ്നപദ്ധതിയായ മേക്ക് ഇന് ഇന്ത്യതന്നെ അവതാളത്തിലായി | |

| Supreme Court pitches for Uniform Civil Code, one rule, one India for every citizens  NEW DELHI: The Supreme Court has granted three weeks time to the government to come up with a proposal to amend the Divorce Act and inform it whether it was willing to bring the Uniform Civil Code in the country. "We have requested the Solicitor General, who is present in Court, to look into the matter. He prays for three weeks' time. List after three weeks," a bench of Justices Vikramjit Sen and Shiva Kirti Singh said. "There is total confusion we should work on the Uniform Civil Code. What happened to it? | Sanjiv Bhatt's fall from grace after SC verdict damages the anti-Modi brigade Sanjiv Bhatt, the expelled ex-IPS officer, on whom the entire case against Prime Minister Narendra Modi for the latter's alleged role in the 2002 riots and the hopes of many opposed to Modi rested, has been finally handed down a judicial invalidation from the country's highest court. His theories were, really, just theories. The Supreme Court was hearing a plea by Bhatt to transfer an FIR against him for coercing and illegally forcing his driver, constable KD Panth, to prepare an affidavit to his liking. While deposing before the SC-appointed Special Investigation Team (SIT), Bhatt was accompanied by his then driver Panth who, Bhatt wished, would corroborate Bhatt's claim that he attended the 27 February 2002 meeting at Modi's residence (In 2002, Modi was Gujarat CM) when the Gujarat riots, in the wake of the Godhra train burning, were about to worsen. While Panth had originally confirmed that he drove Bhatt to Modi's residence, he later retracted. A critical fact to be mentioned here is that Bhatt insisted that Panth be examined by SIT in his presence - something the SC termed as "pressure tactics". The petition before the SC was, among other things, to transfer investigation in that FIR to an independent agency outside Gujarat. While denying Bhatt's request, the SC bench, which included the Chief Justice of India, finally got the opportunity to examine the various machinations and strategising done by Bhatt to sustain his theory. The full text of SC judgment can be read here. First and foremost, the records clearly establish that Panth was not even in Gujarat between 25 February and 28 February 2002. Not only that, when Bhatt wanted Panth to testify that he drove Bhatt to the CM's residence, Bhatt took Panth to the then President of the Gujarat Congress and Chairman of the Legal Cell for the preparation of his affidavit. Other portions of the judgment reveal Bhatt's machinations to confirm his theories. There are email exchanges between Bhatt and a Gujarat Congress leader showing receipt of a "package", of Bhatt being "underexploited" (in the case) and him asking the Congress member to "try to mobilise support/pressure-groups in Delhi to influence him (the Amicus Curiae Raju Ramchandran) in a very subtle manner". It is useful to point out here that Ramchandran had opined that Modi could be prosecuted based on Bhatt's allegations alone. This author had back then pointed out serious deficiencies in the opinion. Then there are email exchanges between Bhatt and a journalist, wherein Bhatt tries to have the journalist mention that he had met Bhatt on 27 February when he was "about to go to the disputed meeting". Bhatt later emailed a TV channel member that he had filed an affidavit stating that the journalist was with him when he had to leave for a meeting at Modi's residence and that the channel member should "confirm through your sources in SC". Bhatt even asked the journalist whether he would be comfortable with another media person. This, as SC observed in the judgment, was Bhatt's attempt at "recreating" his whereabouts on the night of the meeting. When the correspondent shied away, Bhatt wrote to him that they "could let the press sniff it out and contact" him. This will "finally force the hand of amicus and SC to take notice and subsequent affirmative action". In a follow-up email, Bhatt told the journalist that if he feared amicus and SC may not take it seriously, then "media trick can be tried". In his emails with an activist of the Narmada Bachao Andolan, Bhatt advised her that "pressure groups and opinion makers in Delhi can be of great help in forwarding the cause". Bhatt wanted to create a situation where it would be difficult for the SC bench hearing Zakia Jafri’s petition to disregard the shortcomings of the SIT report on the Gulbarg society killings where Jafri’s husband died. What's perhaps the most direct evidence of Bhatt acting in connivance with the Congress, he writes to an NGO head that he will "take it up with someone in the party" and get "suitably instructed". The SC verdict also takes cognisance of one vital fact which exposed Bhatt’s lie that he was present at the meeting at Modi's residence on 27 February. He tries to ascertain former minister Haren Pandya's whereabouts on the night in question. This is because Bhatt had stated that Pandya was also there at the meeting. Pandya's cellphone location revealed that he was not there at the meeting. An earlier column by this author on Raju Ramchandran's deficient legal reasoning alludes to this discrepancy. This led the SC to state that Bhatt was "not acting bona fide and was catering to the interest elsewhere". The court also observed how Bhatt kept quiet for nine years about the meeting. These machinations (the emails, the connivance with Congress, NGOs, etc) made it clear that, in SC's words, Bhatt had "not come to the Court with clean hands". The Supreme Court bench also noted a deliberate attempt on the part of Bhatt to mislead it. Bhatt alleged that SIT was leaking sensitive and confidential details pertaining to the riots to the then Additional Advocate General. In fact, as SC noted, Bhatt knew that those emails had nothing to do with riots, but the fake encounter cases. As the SC noted, Bhatt revealed only the covering text of the e-mails and "intentionally avoided the enclosures because the same would have exposed falsity of his stand." When Bhatt made up these theories back in 2011, he was the toast of those who did not want Modi to rise. He got maximum media coverage (much of which can be explained in his emails) and NGOs and Bollywood celebrities stood by him. His every word was Gospel; he was a national icon and a courageous whistleblower. Today it would be difficult to find anybody stand in his support after the SC has exposed his "unclean hands" threadbare. This is Bhatt's fall from grace. It hurts not only him, but the hate-Modi brigade. | |

| How Congress' efforts to nail NDA and Modi have exploded in its face One by one, the UPA's desperate efforts to cover up its own scams by trying to implicate the previous NDA and - later Narendra Modi himself - are being shown up for what they are: a sham, and a naked effort to misuse the CBI and pressure the judicial system to constrain and embarrass its main political rival, the BJP. Yesterday (15 October), a special 2G court delivered a third consecutive slap to the UPA in less a week when it threw out a flawed CBI case to implicate Shyamal Ghosh, telecom secretary during the Vajpayee era, when Pramod Mahajan was minister. The court effectively said that the chargesheet was cooked up "for extraneous reasons". Ghosh was accused of favouring Hutchison Max (now part of Vodafone), Sterling Cllular and Bharti Cellular with extra spectrum. It was left to Arun Jaitley to clearly lay the blame in the right quarter. He blogged that, "there is no doubt that the chargesheet was filed at the behest of Kapil Sibal, the telecom minister in the UPA government." Yes, the same Kapil "zero loss" Sibal, A Raja's worthy successor, who was handpicked to fling mud on the previous NDA in order to take the heat off the Manmohan Singh government in the 2G scam. That Ghosh got his reprieve from OP Saini, the Special Judge in 2G cases, is sweet justice for it clearly suggests that the scam had its origins in UPA's machinations and not the NDA's. When though the late Pramod Mahajan was no angel, the fact is the telecom policy mess left behind by the Narasimha Rao and UF governments was finally cleared up by the NDA, with Arun Shourie playing the cleanup guy. His clean up set the stage for robust growth, but the UPA messed up again by making the industry again scam-ridden. The two previous rebukes to the UPA, and specially the Congress, came not from a trial court, but the Supreme Court itself. On 13 October, the court tossed out the Congress-fostered Kargil coffin scam - intended to tarnish George Fernandes, who was defence minister in Vajpayee's government. While a trial court had already cleared the name of Fernandes and all accused in the coffin purchase case, including Jaya Jaitley, a PIL was filed against the CBI's final report. It was this PIL that bit the dust this week. The most embarrassing setback, of course, came in the Sanjiv Bhatt case, when the Supreme Court dismissed his plea for a special investigation team (SIT) to investigate an FIR against him filed by the Gujarat government that alleges that Bhatt forced his driver to falsely corroborate his claim that he was present at a meeting called by Modi as chief minister of Gujarat on 27 February 2002, after the Godhra train burning had inflamed communal passions. The apex court flushed this plea down the toilet saying Bhatt had come "with unclean hands". Among other things, the court found Bhatt, a former Gujarat IPS officer, playing the Congress' game and using NGOs and parts of the media to pressure the amicus curiae who was asked to vet the SIT that exonerated Modi in the 2002 riots. This judgment, even though it relates to Sanjiv Bhatt, is actually damning for the Congress, for it clearly establishes that it was mortally afraid of Modi's rise and wanted him out of the way by framing him for the Gujarat riots when even the SIT had found nothing to implicate him. That the Lutyens media too was willing to play ball with the Congress to repeatedly waylay Modi is a sad commentary on how the politician-media nexus works in Delhi. | |

| Court slams CBI for 'fabricating facts' over 2G scam; BJP seeks Cong apology for 'fake charges'
The BJP on Thursday sought an apology from the Congress after a special Central Bureau of Investigation (CBI) court found a case that alleged scam in 2G spectrum allocation during the Atal Bihari Vajpayee government's tenure "false and fabricated" and cited some recent judicial orders to accuse it of conspiring to tarnish its leaders, including late Pramod Mahajan.
Earlier in the day, CBI special judge OP Saini dropped charges against former telecom secretary Shyamal Ghosh and three companies -- Bharti Cellular Ltd, Hutchison Max Telecom Pvt Ltd (now Vodafone India Ltd) and Sterling Cellular Ltd (now Vodafone Mobile Service Ltd) -- in the 2002 additional spectrum allocation case, observing that a "fabricated" charge-sheet was drafted to create an impression that the demand for additional spectrum began only when BJP leader Pramod Mahajan became the telecom minister.
"I find that there is no incriminating material on record against the accused and the accused deserve to be discharged," special judge Saini said in a 235-page order, according to an IANS report. "The charge-sheet has been drafted in such a manner as to create an impression that the demand for additional spectrum began only on the joining of Pramod Mahajan as minister."
The case related to the department of telecommunications allocating additional spectrum in a decision taken on January 31, 2002, when the National Democratic Alliance (NDA) was in power, allegedly resulting in a loss of Rs 846 crore to the exchequer. Mahajan, who died in 2006, then headed the telecom ministry.
BJP alleges conspiracy by Congress
Reacting to the court order, Union Minister Prakash Javadekar said in the evening that various judicial orders, including two from the Supreme Court, had exposed the conspiracies being hatched by the opposition party to defame Prime Minister Narendra Modi and the previous NDA government.
Javadekar recalled the then minister Kapil Sibal's statement after A Raja's resignation as the telecom minister in the UPA government over the 2G spectrum allocation scam that its policy on the matter was continuation of the previous Vajpayee dispensation's decision.

According to reports, Javadekar also cited the indictment of dismissed Gujarat cadre IPS officer Sanjiv Bhatt, who had tried to link the then chief minister of state Narendra Modi to 2002 riots, by the Supreme Court to accuse the Congress of being the "handler and conspirator" and using the former top cop as a "pawn".
"The lies of Congress have been exposed. Its conspiracy has fallen apart. We seek an apology from Congress. After these orders, it is not saying anything. It is resorting to spit, run and hide tactic," Javadekar told reporters at a press conference. He alleged that the Congress ran a campaign against Modi, now the prime minister, for 13 years on the basis of Bhatt's false allegations.
'Coffin scam' charge also Congress 'conspiracy'
The minister also referred to the 'coffin scam' to prove how the Congress conspired against the then Defence Minister George Fernandes and boycotted him on the issue. He said the Supreme Court had dismissed a bunch of petitions seeking a probe into the alleged scam related to the purchase of defence equipments during and after the 1999 Kargil war.
"All the lies of Congress have been unmasked. For 15 years, it hounded Fernandes. For 13 years, it tried to defame Modi by using Bhatt," Javadekar said. | |
