Prime Minister Narendra Modi's office can’t say if “achhe din” have indeed arrived — it just doesn’t have the records.

Early this month, Modi’s office received a query under the right to information act: “if the PMO has witnessed the arrival of achhe din aka good days since 16th May 2014 across India”.

The PMO expressed inability to answer the apparently mischievous query sent in by Tehseen Poonawala, a pro-Congress entrepreneur.

"It may please be noted that under the act, only information which is held or accessible as per records can be provided," the PM’s office said in a July 28 reply.
The query was not specific and had “a qualitative opinion/view” that was beyond the scope of the act, SE Rizvi, director and central public information officer, added to the PMO reply.

Modi, the PM, had gone back on every poll promise he made, Poonawala told HT.

The Modi government took oath of office on May 16, riding high on BJP’s poll pitch of achhe din aane wale hai (good days are round the corner).

he Delhi High Court on Friday ordered that the proposed e-mail policy, restraining government officials from using services of offshore internet service providers for official purposes, be placed before the Cabinet "at the earliest" for the approval.

"The Additional Solicitor General also states that the draft e-mail policy is now ready for being placed before the Cabinet for approval. The same be done at the earliest," a bench of justices BD Ahmed and Sidhharth Mridul said.

The court referred to an incident in which National Investigation Agency (NIA) had passed on sensitive information relating to a terror case to its officials by using Google services.

"The use of internet services, which transfers public data to offshore locations, concerns the integrity and sovereignty of the country. Why public records should go outside India? This is not permissible under the law," the bench said.

The bench, which also passed a slew of directions, was hearing a PIL filed by former BJP leader KN Govindacharya through his lawyer Virag Gupta. Govindacharya has raised various issues including use of e-mail services, provided by offshore providers, by government officials for official purposes.

The websites evade taxes and make public the personal details of Indian users, the PIL alleged, adding even minors below 13 years of age are being allowed to use Facebook. During the hearing, the counsel for Govindacharya alleged it is a matter of common knowledge that various ministries, including the PMO, have opened accounts on social networking sites -- Facebook and Twitter -- and it is against the Public Records Act and court directions as official records go to servers outside India.

"We are not on Facebook so you please file an additional affidavit on the issue," the bench said. Additional Solicitor General (ASG) Sanjay Jain, appearing for the Centre, said he will take instruction and make a statement before the court on September 26, the next date of hearing.

The court also asked the ASG to make a "categorical" statement on the issue of payment of service tax by websites including Google and Facebook for their commercial operations in India.

On the allegation that certain foreign websites do not pay service tax, the bench said "we do not pass any assessment orders. We just wanted to confirm as to whether the government authorities are acting as per law or not".

It also asked the Centre to file a status report in pursuance of an earlier order on appointment of Grievance Officers by internet firms, including Twitter, under the IT (Intermediary Guidelines) Rules to deal with users' complaints. Govindacharya, in the PIL, has also alleged that websites evade taxes and make public the personal details of Indian users.

The plea has also sought a direction to ensure safety of the data of 140 million Indian users which are transferred "to the US and is being used for commercial gains in violation of the right to privacy."

'ട്രൂത്ത് ഡ്രഗ്ഗുകള്‍'ക്ക് സത്യം പറയിപ്പിക്കാന്‍ കേവലസാധ്യത മാത്രമാണുള്ളതെന്ന് അദ്ദേഹം പരീക്ഷണത്തിലൂടെ തെളിയിക്കുകയുണ്ടായി. ഒരു മനോരോഗിക്ക് ട്രൂത്ത് ഡ്രഗ്ഗ് നല്കിയും അല്ലാതെയും അദ്ദേഹം കൌണ്‍സിലിങ് നടത്തിയപ്പോള്‍ കിട്ടിയ ഫലത്തില്‍ കാര്യമായ വ്യത്യാസമൊന്നും അനുഭവപ്പെട്ടില്ലത്രെ. യു.എസ്സിലെ പ്രശസ്ത മനഃശാസ്ത്രജ്ഞനായ ഫ്രീദ്മാനും മക്ഡൊണാള്‍ഡിന്റെ അഭിപ്രായത്തെ ശരിവയ്ക്കുന്നു. സോഡിയം അമൈതാല്‍ കുറ്റാന്വേഷണത്തെക്കാള്‍ മനഃശാസ്ത്ര ചികിത്സയിലാണ് കൂടുതല്‍ പ്രയോജനപ്രദമെന്നും ഫ്രീദ്മാന്‍ നിരീക്ഷിച്ചിട്ടുണ്ട്. രണ്ടാം ലോകയുദ്ധകാലത്ത് യു.എസ്. കുറ്റാന്വേഷണ സംഘത്തിലുണ്ടായിരുന്ന റോയ് ആര്‍. ഗ്രിങ്കറിന്റെയും ജോണ്‍ സി. സ്പീഗലിന്റെയുമെല്ലാം അനുഭവസാക്ഷ്യവും മക്ഡൊണാള്‍ഡിന്റെയും ഫ്രീദ്മാന്റെയും വാദത്തെ ശരിവയ്ക്കുന്നു. നാര്‍ക്കോട്ടിക് മരുന്നുകള്‍ കുത്തിവയ്ക്കുന്നതിലൂടെ ഒരാളുടെ ഭാവനാശക്തിയെ താത്കാലികമായി ഇല്ലാതാക്കാന്‍ കഴിയുമെന്ന നാര്‍ക്കോ അനാലിസിസിനെ സംബന്ധിച്ച സാമാന്യനിഗമനം പല പരീക്ഷണങ്ങളിലും തെറ്റിയിട്ടുണ്ട്. ചോദ്യം ചെയ്യപ്പെടുന്ന ആള്‍ നാര്‍ക്കോട്ടിക് മരുന്നുകളെ അതിജീവിച്ച് കരുതിക്കൂട്ടി അസത്യമൊഴികള്‍ നല്കിയതായി പിന്നീട് തെളിയിക്കപ്പെട്ടിട്ടുണ്ട്. ചോദ്യം ചെയ്യപ്പെടുന്ന വ്യക്തി നല്കുന്ന മൊഴി അയാളുടെ 'ഓര്‍മ'യുമായി ഏറെ ബന്ധപ്പെട്ടിരിക്കുന്നു. എന്നാല്‍ ഒരാളുടെ ഓര്‍മശക്തിയെ ഉദ്ദീപിപ്പിക്കുന്നതിന് 'ട്രൂത്ത് ഡ്രഗ്ഗുകള്‍' പര്യാപ്തമല്ല. അഥവാ ഓര്‍മപ്പിശക് കാരണവും ഒരാളുടെ മൊഴികള്‍ അസത്യമായി വരാം. ഇത് തിരിച്ചറിയാന്‍ നാര്‍ക്കോ അനാലിസിസില്‍ യാതൊരു മാര്‍ഗവുമില്ലെന്നതും അതിന്റെ ന്യൂനതയായി ചൂണ്ടിക്കാണിക്കപ്പെടുന്നു.
നാര്‍ക്കോ അനാലിസിസിനെതിരായ വിമര്‍ശനങ്ങള്‍ കേവലം അതിന്റെ ശാസ്ത്രീയതയെച്ചൊല്ലി മാത്രമുള്ളതല്ല. 1950-കളില്‍ത്തന്നെ അത് വലിയ മനുഷ്യാവകാശപ്രശ്നമായും ഉയര്‍ത്തിക്കാട്ടപ്പെട്ടിട്ടുണ്ട്. മുമ്പ് നാര്‍ക്കോ പരീക്ഷണങ്ങള്‍ക്ക് വിധേയമായവരില്‍ കണ്ട വിവിധ ആരോഗ്യപ്രശ്നങ്ങളാണ് ഇത്തരമൊരു വിമര്‍ശനത്തിന് വഴിയൊരുക്കിയത്. ടെസ്റ്റിന് വിധേയരായ യുദ്ധത്തടവുകാര്‍ക്കും മറ്റും അധിക അളവില്‍ നാര്‍ക്കോട്ടിക് മരുന്നുകള്‍ കുത്തിവച്ചിരുന്നുവത്രെ. ഇതിന്റെ പാര്‍ശ്വഫലങ്ങള്‍ പിന്നീട് പലതരത്തിലുള്ള അസുഖങ്ങളായി പ്രത്യക്ഷപ്പെടുകയും ഗുരുതരമായ ആരോഗ്യപ്രശ്നങ്ങള്‍ക്ക് വഴിവയ്ക്കുകയും ചെയ്തു. ഇത്തരം പ്രശ്നങ്ങള്‍ വിവിധ മനുഷ്യാവകാശ സംഘടനകള്‍ ഉയര്‍ത്തിക്കൊണ്ടുവന്നതോടെ നാര്‍ക്കോ അനാലിസിസ് ഒരു മൂന്നാം മുറയായും (Third Degree) മാനസിക പീഡനമായും ചിത്രീകരിക്കപ്പെടുകയുണ്ടായി. ജൂട്ട് മെര്‍ലോയുടെ ദ് റെയ്പ് ഒഫ് ദ മൈന്‍ഡ് നാര്‍ക്കോ അനാലിസിസിന്റെ അശാസ്ത്രീയതയും അതു സൃഷ്ടിച്ച മനുഷ്യാവകാശ പ്രശ്നങ്ങളും വിശദമായി പ്രതിപാദിക്കുന്ന ഒരു ഗ്രന്ഥമാണ്.
1989-ലാണ് നാര്‍ക്കോ അനാലിസിസിനെതിരായി ആദ്യമായി ഒരു കോടതി ഇടപെടല്‍ ഉണ്ടാകുന്നത്. ന്യൂ ജഴ്സിയിലെ ഹൈക്കോടതി ഒരു കേസില്‍ സോഡിയം അമൈതാല്‍ ട്രൂത്ത് ഡ്രഗ്ഗായി ഉപയോഗിക്കുന്നത് നിരോധിച്ചുകൊണ്ടുള്ളവിധി പുറപ്പെടുവിച്ചതായിരുന്നു പ്രസ്തുത ഇടപെടല്‍.
നാര്‍ക്കോ അനാലിസിസ് ഒരു ശാസ്ത്രീയ കുറ്റാന്വേഷണ മുറയായി സ്വീകരിച്ച രാജ്യമാണ് ഇന്ത്യ. കുപ്രസിദ്ധമായ മുദ്രക്കടലാസ് കുംഭകോണം, അഭയാ കേസ്, നിതാരി കൊലക്കേസ് തുടങ്ങി ഒട്ടേറെ കേസുകള്‍ക്ക് തെളിവുകള്‍ ശേഖരിക്കാന്‍ നാര്‍ക്കോ അനാലിസിസ് രീതി അവലംബിച്ചിട്ടുണ്ട്. ബാംഗ്ലൂരിലെ വിക്ടോറിയ ഹോസ്പിറ്റലും ഗാന്ധിനഗറിലെ ഫോറന്‍സിക് സയന്‍സ് ലബോറട്ടറിയുമാണ് രാജ്യത്തെ പ്രധാന നാര്‍ക്കോ അനാലിസിസ് കേന്ദ്രങ്ങള്‍. എന്നാല്‍ മറ്റു പല രാജ്യങ്ങളിലെയും പോലെ ഇന്ത്യയിലും നാര്‍ക്കോ അനാലിസിസിന്റെ ശാസ്ത്രീയതയും അതുയര്‍ത്തുന്ന വെല്ലുവിളികളും ചര്‍ച്ചയായിട്ടുണ്ട്. 1872-ലെ ഇന്ത്യന്‍ തെളിവുനിയമം (Indian Evidence Act 1872) നാര്‍ക്കോ അനാലിസിസിനെ എത്രത്തോളം സാധൂകരിക്കുന്നു എന്നതാണ് ചര്‍ച്ചകളുടെ മര്‍മം. ഇന്ത്യന്‍ ഭരണഘടനയിലെ രണ്ടു വകുപ്പുകള്‍-ആര്‍ട്ടിക്കിള്‍ 20 (3) ഉം ആര്‍ട്ടിക്കിള്‍ 21-ഉം - പ്രകാരം നാര്‍ക്കോ അനാലിസിസ് നിയമവിരുദ്ധമാണ് എന്നതാണ് വിമര്‍ശകരുടെ പ്രധാനവാദം. ആര്‍ട്ടിക്കിള്‍ 20 (3) പ്രകാരം, ഒരാള്‍ക്ക് സ്വയം കുറ്റം ഏറ്റു പറയുകയോ സ്വന്തം ഇഷ്ടപ്രകാരമല്ലാതെ നിര്‍ബന്ധത്തിനു വഴങ്ങി സാക്ഷിപറയുകയോ (self incrimination) ചെയ്യേണ്ടതില്ല. അതുപോലെ ആര്‍ട്ടിക്കിള്‍ 21 ജീവിക്കാനുള്ള അവകാശത്തെ വകവയ്ക്കുകയും മാനസിക പീഡനത്തെ (mental torturing) തടയുകയും ചെയ്യുന്നു. ഈ രണ്ട് വകുപ്പുകള്‍പ്രകാരം നാര്‍ക്കോ അനാലിസിസ് പരീക്ഷണങ്ങള്‍ മൂന്നാം മുറയായി പരിഗണിച്ച് അത് നിരോധിക്കണമെന്നാണ് ഇന്ത്യയിലെ പ്രമുഖ മനഃശാസ്ത്ര വിദഗ്ധരായ ഡോ. പി. ചന്ദ്രശേഖര്‍, ഡോ. ബി.എം. മോഹന്‍ എന്നിവരുടെ അഭിപ്രായം. എന്നാല്‍ ഇത്തരം വിമര്‍ശനങ്ങളെ മറികടന്നുകൊണ്ട് ഇന്ത്യയിലെ ചില ഹൈക്കോടതികള്‍ നാര്‍ക്കോ അനാലിസിസിന് അനുമതി നല്കിയിട്ടുണ്ട്. 2004-ല്‍ ബോംബെ ഹൈക്കോടതി മുദ്രക്കടലാസ് കുംഭകോണക്കേസില്‍ നാര്‍ക്കോ അനാലിസിസിന് അനുമതി നല്കിക്കൊണ്ടുള്ള വിധി പുറപ്പെടുവിക്കുകയുണ്ടായി. സാങ്കേതിക സാഹചര്യങ്ങളൊരുക്കിയുള്ള തെളിവെടുപ്പ് യാതൊരു തരത്തിലും 20 (3) ന് ചട്ടവിരുദ്ധമാകില്ലെന്ന് പ്രസ്തുത വിധിപ്രസ്താവത്തില്‍ പറയുന്നു. 2006-ല്‍ ദിനേശ് ദാല്‍മിയ - തമിഴ്നാട് സര്‍ക്കാര്‍ കേസിലും തമിഴ്നാട് ഹൈക്കോടതി സമാന വിധിയാണ് പുറപ്പെടുവിച്ചത്. എന്നാല്‍ അതേവര്‍ഷത്തില്‍ത്തന്നെ, ക്രൂപ്പി കോ-ഓപ്പറേറ്റീവ് അര്‍ബന്‍ ബാങ്ക് കേസില്‍, കെ. വെങ്കിടേശ്വരന്‍ എന്നയാളെ നാര്‍ക്കോ അനാലിസിസ് നടത്താന്‍ അനുമതി നല്കിക്കൊണ്ടുള്ള മെട്രോപൊളിറ്റന്‍ ജഡ്ജിയുടെ വിധി സുപ്രീംകോടതി തടഞ്ഞു. തന്നെ നാര്‍ക്കോ അനാലിസിസിന് വിധേയനാക്കാനുള്ള നീക്കത്തിനെതിരെ ഇയാള്‍ നല്കിയ അപ്പീലിന്റെ പുറത്താണ് സുപ്രീംകോടതി ഈ ഇടക്കാല വിധി (Interim verdict) പുറപ്പെടുവിച്ചത്. ഈ വിഷയത്തില്‍ രാജ്യത്തെ ഉന്നത നീതിപീഠത്തിന്റെ ആദ്യ വിധി പ്രസ്താവനയായിരുന്നു ഇത്.
2010 മേയ് 5-ന് സുപ്രീംകോടതി ചീഫ് ജസ്റ്റിസ് കെ.ജി. ബാലകൃഷ്ണന്റെ നേതൃത്വത്തിലുള്ള ബഞ്ച് ഇതു സംബന്ധിച്ച അന്തിമവിധി പുറപ്പെടുവിക്കുകയുണ്ടായി. ഒരാളെ നിര്‍ബന്ധപൂര്‍വം ഇത്തരം പരീക്ഷണങ്ങള്‍ക്ക് വിധേയമാക്കുന്നത് ഭരണഘടനാ വിരുദ്ധമാണന്നാണ് ഈ വിധിയുടെ രത്നച്ചുരുക്കം. ഇത്തരം പരീക്ഷണങ്ങള്‍ ഒരാളുടെ സ്വകാര്യതയെ ഹനിക്കലാണെന്നും ഈ പരീക്ഷണഫലങ്ങള്‍ നേരിട്ട് സ്വീകരിക്കാവുന്നതല്ലെന്നും 251 പേജ് വരുന്ന വിധി പ്രസ്താവത്തില്‍ പറയുന്നു.

Ahmedabad: Supreme Court judge Justice AR Dave today said that Indians should revert to their ancient traditions, and texts such as Mahabharata and Bhagwad Gita should be introduced to children at an early age.

"Our old tradition such as 'Guru Shishya parampara' is lost, if it had been there, we would not have had all these problems (violence and terrorism) in our country," Justice Dave said, speaking at an international conference on 'contemporary issues and challenges of human rights in the era of globalisation' in Ahmedabad.

"Now we see terrorism in countries. Most of the countries are democratic....If everybody in a democratic country is good then they would naturally elect somebody who is very good. And that person will never think of damaging anybody else," he said.

"So by bringing (out) all the good things in each and every human being, we can stop the violence everywhere. And for that purpose we have to go back to our own things again."

The conference had been organised by Gujarat Law Society (GLS).

The judge also proposed that Bhagwad Gita and Mahabharata should be introduced to students from the first standard.

"Somebody who is very secular... so called secular will not agree... Had I been the dictator of India, I would have introduced Gita and Mahabharata in class one. That is the way you learn how to live life. I am sorry If somebody says I am secular or I am not secular. But if there is something good, we have to get it from anywhere," Justice Dave said.

In Nepal, PM Modi Reunites Jeet Bahadur with His Family after 16 Years

Kathmandu: In a special humanitarian gesture, Prime Minister Narendra Modi today witnessed a Nepalese youth reuniting with his family after having nurtured him for 16 years.

26-year-old Jeet Bahadur, who is currently pursuing a Bachelors in Business Administration (BBA) course in Ahmedabad, had come to India in 1998 along with his brother looking for work like many other migrants from Nepal.

Mr Bahadur came in contact with Mr Modi in Ahmedabad over a decade back and has since been looked after by him. On Sunday, he travelled with Mr Modi to Kathmandu to be personally handed over to his mother and elder brother.

At the hotel where the Indian delegation is staying, Mr Modi met Bahadur's family members who have moved here from their native place Kawasoti in Nawalparasi district in western Nepal where they live in a slum area.

His family members include his mother Khagisara, elder brother Dasharath, his wife and younger sister Prem Kumari.

"Bringing a family together! @PMOIndia 1st engagement in Nepal was to bring together Jeet Bahadur's family," Spokesperson in the Ministry of External Affairs Syed Akbaruddin tweeted along with a photograph of the Mr Modi with Bahadur's family.

After coming to India with his elder brother, Bahadur worked in Rajasthan for a brief period. However, after sometime, he decided to return to Nepal as he was unhappy with his job.

While leaving Rajasthan, he mistakenly boarded an Ahmedabad-bound train instead of one going to Gorakhpur in Uttar Pradesh, which borders Nepal.

On arriving in Ahmedabad, a woman took him to the house of Mr Modi who had till then not become the Chief Minister. Since then, Bahadur has been in Mr Modi's care.

However, after Mr Modi became the Prime Minister and moved to Delhi, Bahadur shifted to a university hostel.

Indian Embassy officials in Kathmandu earlier visited Bahadur's family in Kawasoti and informed them about Mr Modi's visit and his desire to meet them.

On the eve of his two-day trip yesterday, Mr Modi had tweeted, "On a personal note, my Nepal visit is very special...Some personal emotions are also attached to this visit."

The more than month-long budget session of parliament seems to have run out of steam with the government failing to draw up a legislative agenda for the remaining two weeks, a situation the opposition blames on the "inexperience" of the new dispensation.

Though the current session is scheduled till Aug 14, the government has not listed any legislative business for Monday in the Lok Sabha. Both the Congress and the Trinamool Congress raised the issue in the Lok Sabha on Friday but were informed by the speaker that listing the business is a convention and is not mandatory.

In the Rajya Sabha, the government has announced its plans to take up a bill to amend the insurance law, its first initiative towards economic reforms.

"This reeks of lack of experience in running parliament," Trinamool Congress MP Saugata Roy told IANS.

"The prime minister himself is new. He is not giving adequate directions. He leaves for Nepal Sunday, which again means that parliamentary business will be in a limbo," he added.

According to Congress' Sanjay Jha: "The BJP, despite an absolute majority, has not been able to have a structured approach to legislative issues."

"There are so many crucial bills which need to be taken up on an urgent basis like the anti-corruption bills and the judicial accountability bills," Jha told IANS.

According to PRS Legislative Research, when the 15th Lok Sabha ended its term, 128 bills were pending in parliament - 68 in the Lok Sabha, which lapsed with its dissolution and 60 in the Rajya Sabha.

The parliamentary affairs ministry had announced a tentative list of 15 bills to be discussed and passed and five bills to be introduced during the budget session. However, almost no new bills have yet been cleared by the cabinet.
