On July 24, HC summoned the Kutch collector with a survey report, but the officer arrived without any report. He told the court that he was not aware of the HC directions. He also even issued a notice to his clerk for not conveying to him the HC's instructions for the survey and report on whether the sand dunes were flattened. The petitioner in this case, Praveensinh Jadeja, alleges that the industrial group is leveling the sand dunes in order to show that the land is reclaimed. The PIL claimed that the sand dunes near the shore act as a natural wall, and protect the region from natural calamities like tsunamis, high tides and cyclones. This makes the region a CRZ-1 region. But the company has obtained environmental permission by making a false presentation, because the report does not refer to sand dunes in the region.He also submitted that the sand dunes in question were not allocated to the company by the government for the purpose of making a ship-breaking yard near Tunda. "In the absence of any report, the HC asked the forest department to ensure that there is no removal of sand dunes from the seashore," said the petitioner's advocate N L Jain. | |

| India’s largest dam given clearance but still faces flood of oppositionThe 3,000MW Dibang dam, rejected twice as it would submerge vast tracts of biologically rich forests, is to get environmental clearance – but huge local opposition could stall the project ix years ago, former Indian prime minister Manmohan Singh laid the foundation stone for the 3,000MW Dibang multipurpose dam project. The dam, to be built across the Dibang river, in the north-eastern state of Arunachal Pradesh, will be the country’s largest. The state plans to build more than 160 dams in the coming years. Dibang dam will not only generate power but supposedly control floods in the plains of neighbouring Assam state. The dam’s reservoir was estimated to submerge 5,000 hectares (12,000 acres) of dense forests along the Dibang river valley. The forest advisory committee (FAC), which examines the impact of infrastructure projects on wilderness areas, was appalled and rejected it. For a project so large, the environmental impact assessment (EIA) failed to assess critical components of the project and was widely criticised for inadequately predicting the dam’s effects on the environment. Its evaluation of impacts on wildlife is a farce. The authors of the document list creatures not found in that area, such as Himalayan tahr, and concocted species not known to exist anywhere in the world, such as brown pied hornbill. Of the ones they could have got right, they mangled the names, referring to flycatchers as ‘flying catchers’ and fantail as ‘fanter’. In his scathing critique, Anwaruddin Choudhury, an expert on the wildlife of north-east India, sarcastically concluded the EIA makes a case for the project to be shelved, as Dibang was the only place in the world “with these specialities!” Despite listing these amazing creatures, the EIA goes on to say “no major wildlife is observed”. In a similar vein, the document claims only 301 people will be affected by the dam. Authorities must be puzzled that a project with so few affected people should be opposed by so many. Protests by local people began soon after the inaugural stone was laid in 2008. Since then large crowds have disrupted public hearings. On 5 October 2011, police fired on one such mass demonstration, injuring 10 people. Regional authorities branded anti-dam protestors as Maoist rebels, further angering them. In Arunachal Pradesh, the Idu Mishmi and Adi tribes will be the most affected. They fear loss of grazing land, fishing grounds, and lack of safety of the dam in a seismically volatile zone. Additionally, they are concerned that the large number of workers needed to build the dam will overwhelm their cultural identity and their lands. People protesting Dibang dam in Arunachal Pradesh. When the FAC first rejected the project in June 2013, it said the “ecological, environmental and social costs of diversion of such a vast track of forest land, which is a major source of livelihood of the tribal population of the state, will far outweigh the benefits likely to accrue from the project”. Some of the grassland-covered river islands in the Dibang river are the prime habitat of the critically endangered Bengal florican. The ministry’s recovery plan for the bird species recommends the area be designated as a national park. Neeraj Vagholikar, an environmentalist familiar with the case, who works for NGO Kalpavriksh, lists the concerns of people downstream in Assam: loss of fisheries, loss of agricultural land on river islands, increased vulnerability to floods caused by removal of boulders from riverbeds for dam construction, sudden release of water from the reservoir in the monsoons, and safety of the dam in a geologically fragile and seismically active region. Under public pressure, Assam chief minister Tarun Gogoi told prime minister Narendra Modi in July this year, “We urge that all hydro electric projects be taken up only after consideration of dam safety, flood moderation and downstream impact mitigation measures in consultation with government of Assam.”Arunachal Pradesh resubmitted the proposal in February 2014, dropping the height of the dam from 288 metres to 278 metres and saving 1,100 acres of forest. The FAC rejected it again in April 2014. Prakash Javadekar’s ministry of environment and forests also rejected the proposal on 28 August 2014, and cited these reasons in its letter: “[The] proposed area is very rich in biodiversity, sensitive ecosystem being at the edge of hills and flood plains and having large number of endemic and endangered flora and fauna, etc. Moreover, such project is most likely to have considerable downstream impact including impact on the Dibru-Saikhowa NP [national park] in Assam which is yet to be studied.”That ought to have put paid to the dam project. Instead, the prime minister’s principal secretary revived it in early September. This time it sailed through the clearance process. At the time of writing, the minutes of the FAC meeting granting approval have not been made public, and the final height of the dam is still unconfirmed. Anti-dam activists suspect the height of the dam may be lower by 20 metres, and the dam is likely to submerge 4,300 hectares (10,586 acres) of forest. Javadekar has repeatedly stated he supported development without destruction of environment. But it’s just a matter of days before he affixes his seal of approval to the dam.  The FAC’s previous concerns for the area’s biodiversity and the lack of studies of the impact in Assam were brushed aside. A project that claims to control flooding in Assam has not conducted one public meeting in that state nor was the chief minister’s demand for consultation acknowledged. The ministry’s own concerns about the impact on Dibru-Saikhowa national park remain unaddressed. This is the latest in a series of moves made by the government to push large projects at the cost of the environment. When he was a prime ministerial candidate, on 22 February 2014, Modi had said in a speech at Pasighat, Arunachal Pradesh: “I know that the people of the state are against the building of big dams, and I do understand their sentiments. We can still tap those potentials with proper scientific technology and small dams, besides using solar energy to supplement them.” Either he had changed his mind in six months, or he never meant what he said then.  that is what modi isHowever, forcing these approvals through may not make an iota of difference. The 2,000MW lower Subansiri hydroelectric power project got all its clearances, and yet after spending over £500m, the project was brought to a halt in December 2011. The largest anti-dam people’s movement, “unprecedented in India’s hydropower history,” refuses to allow dam construction. Activists believe the buildup of a massive opposition in Arunachal Pradesh and Assam may render the Dibang dam a non-starter too. | |

ന്യൂഡല്ഹി: ജനീവയിലെ എച്ച്.എസ്.ബി.സി ബാങ്കില് അക്കൗണ്ടുള്ള ഇന്ത്യക്കാര്ക്കെതിരെ സര്ക്കാര് പ്രോസിക്യൂഷന്നടപടികള് തുടങ്ങുന്നു. ആദ്യഘട്ടമെന്ന നിലയില് 20-ഓളം പേര്ക്കെതിരെയാണ് സര്ക്കാര് നീങ്ങുന്നത്. സ്വിസ് അധികൃതര് ഈ അക്കൗണ്ടുകളുടെ ഉടമസ്ഥരെക്കുറിച്ചുള്ള വിവരങ്ങള് ഇന്ത്യക്ക് നല്കാമെന്ന് വ്യക്തമാക്കിയിട്ടുണ്ട്.
പ്രോസിക്യൂഷന്നടപടികള് നേരിടുന്നവരുടെ പേരുകള് അടുത്തയാഴ്ച സുപ്രീംകോടതിക്ക് നല്കുമെന്ന് ധനമന്ത്രി അരുണ്ജെയ്റ്റ്ലി കഴിഞ്ഞദിവസം വ്യക്തമാക്കിയിരുന്നു. ജനീവയിലെ എച്ച്. എസ്.ബി.സിയില് 700-ഓളം ഇന്ത്യക്കാര്ക്ക് അക്കൗണ്ട് ഉണ്ടെന്നാണ് വിവരം. എച്ച്.എസ്. ബി.സിയില്നിന്ന് പിരിച്ചുവിട്ട ജീവനക്കാരനാണ് ഇവ ജര്മന്സര്ക്കാറിന് നല്കിയത്. ജര്മന് സര്ക്കാറാണ് ഇതില് നിന്ന് ഇന്ത്യക്കാരെന്ന് സംശയിക്കുന്നവരുടെ വിവരങ്ങള് സര്ക്കാറിന് കൈമാറിയത്.
നേരത്തേ ലിക്റ്റന്സ്റ്റൈനിലെ എല്.ജി.ടി ബാങ്കില് അക്കൗണ്ടുള്ളവരുടെ വിവരങ്ങള് സര്ക്കാറിന് ലഭിച്ചിരുന്നു. 18 അക്കൗണ്ട് ഉടമകളില്നിന്ന് നികുതിയിനത്തില് 24.26 കോടി രൂപ പിഴയീടാക്കി. 18 അക്കൗണ്ടുകളിലായി 44 കോടി രൂപയാണ് എല്.ജി.ടി ബാങ്കില് നിക്ഷേപിച്ചിരുന്നത്. ഇതില് മലയാളിയടക്കമുള്ളവര് ട്രസ്റ്റുകളുടെയും ഫൗണ്ടേഷനുകളുടെയും പേരിലാണ് കള്ളപ്പണം നിക്ഷേപിച്ചിരുന്നത്. ആദായനികുതിവകുപ്പ് ഇവര്ക്കെതിരെ കേസെടുത്തിട്ടുണ്ട്.
ജനീവയിലെ ബാങ്കില് അക്കൗണ്ടുള്ളവരുടെ കൂട്ടത്തിലുള്ള ചില വ്യവസായികളെ ഇതിനകംതന്നെ ആദായനികുതിവകുപ്പ് ചോദ്യംചെയ്തിട്ടുണ്ട്. 800 കോടിരൂപയ്ക്ക് പുറത്ത് നിക്ഷേപം ഇവര്ക്കുണ്ടെന്ന് സംശയിക്കപ്പെടുന്നു. യു.പി.എ സര്ക്കാറില് മന്ത്രിയായിരുന്ന വ്യക്തിയുടെ മകനും മഹാരാഷ്ട്രയില്നിന്നുള്ള പ്രമുഖ നേതാവിന്റെ മകനും എച്ച്.എസ്.ബി. സിയില് അക്കൗണ്ടുള്ളവരുടെ പട്ടികയിലുണ്ട്. ഇവര്ക്കും നോട്ടീസയച്ചിട്ടുണ്ട്. യു.പി.എ സര്ക്കാറിലെ ഒരു മുന്മന്ത്രി, സ്വിസ് ബാങ്കിലെ അക്കൗണ്ട് അവസാനിപ്പിച്ച് ദുബായിലേക്ക് പണം മാറ്റിയതായിട്ടാണ് സര്ക്കാറിന് ലഭിച്ച വിവരം. | |

| മോദിയുടെ നിലപാടുമാറ്റത്തിനെതിരേ വ്യാപക പ്രതിഷേധം ഉയരുകയും അണ്ണാഹസാരെയെ പോലെയുള്ളവര് പ്രത്യക്ഷ സമരത്തിനിറങ്ങാന് തയാറെടുക്കുകയും ചെയ്തതോടെയാണു തീരുമാനത്തില് നിന്നു സര്ക്കാര് അല്പം അയഞ്ഞത്. ദീപാവലി കഴിഞ്ഞ് കോടതി ചേരുമ്പോള് കള്ളപ്പണം പൂഴ്ത്തിയ ചിലരുടെ മാത്രം പേരുകള് വെളിപ്പെടുത്തുമെന്നാണു തിങ്കളാഴ്ചത്തെ മന്ത്രിസഭായോഗം കഴിഞ്ഞു നടന്ന അത്താഴവിരുന്നിനിടെ നരേന്ദ്രമോദി അറിയിച്ചത്. കള്ളപ്പണക്കാരില് ചിലരുടെ പേരു മാത്രം പുറത്തുവിടുമെന്ന മോദിയുടെ വാക്കുകളില് മറ്റു ചിലരെ രക്ഷിക്കാനുള്ള വ്യഗ്രത കൂടിയില്ലേയെന്നു സംശയിക്കാനുള്ള ന്യായങ്ങളും നമുക്കു മുന്നിലുണ്ട്.   കള്ളപ്പണം കണ്ടെത്താന് നിയോഗിച്ച രണ്ടു മുന് സുപ്രിംകോടതി ന്യായാധിപന്മാരുടെ നേതൃത്വത്തിലുള്ള പ്രത്യേകസംഘം ശേഖരിച്ച പേരുകളില് ഒന്ന് ഇന്ത്യയിലെ കോര്പറേറ്റ് വ്യവസായി ഗൗതം അദാനിയുടേതാണ്. വൈദ്യുതി ഉപകരണങ്ങള് വാങ്ങാനെന്ന പേരില് ദുബൈ വഴി മൗറിഷ്യസിലേക്ക് 5468 കോടി രൂപ അദാനി ഗ്രൂപ്പ് കടത്തിയെന്നാണു പ്രത്യേകസംഘത്തിന്റെ കണ്ടെത്തല്. 3580.8 കോടി രൂപയുടെ ഉപകരണങ്ങള് മാത്രമാണ് അവര് ഇറക്കുമതി ചെയ്തത്. എന്നാല് ഈ ഇടപാടിലെ വില പെരുപ്പിച്ചു കാണിച്ച് അദാനി ഗ്രൂപ്പ് ഇന്ത്യയില് നിന്ന് 9048.8 കോടി രൂപയാണ് മൗറിഷ്യസിലേക്കയച്ചത്.  വൈദ്യുതി ഉപകരണങ്ങളുടെ വിതരണക്കാരായ ചൈനീസ്, കൊറിയന് കമ്പനികള്ക്ക് ഇതില് 3580.8 കോടി രൂപ മാത്രമാണ് ലഭിച്ചത്. ബാക്കി മുഴുവന് തുകയും മൗറിഷ്യന് ബാങ്കില് സുരക്ഷിതമായി ഇരട്ടിക്കുന്നു. ആത്മസുഹൃത്തായ അദാനിയെ തൊടാന് നരേന്ദ്രമോദി അല്പം വിയര്ക്കേണ്ടി വരുമെന്ന് തീര്ച്ച.  രാജ്യസുരക്ഷയ്ക്കും പുരോഗതിക്കും വേണ്ടി അല്പം വിയര്ത്താലും കുഴപ്പമില്ലെന്ന മനസ്സാണ് മോദിയുടേതെങ്കില് അത് നല്ലകാര്യം. ഇന്ത്യക്കാരുടെ 50,000 യു.എസ്. ഡോളര് കള്ളപ്പണം വിദേശബാങ്കുകളിലുണ്ടെന്നാണ് 2012 ലെ സി.ബി.ഐ. അന്വേഷണത്തില് വെളിപ്പെട്ടത്. സ്വാതന്ത്ര്യത്തിനു ശേഷം മാത്രം 71 ലക്ഷംകോടി രൂപയാണ് ഇന്ത്യയില് നിന്നു വിദേശത്തേക്കു കടത്തിയതെന്ന് ഗ്ലോബല് ഫിനാന്ഷ്യല് ഇന്റഗ്രിറ്റി റിപ്പോര്ട്ട് പറയുന്നു. ഈ പണത്തിന്റെ ഭൂരിഭാഗവും സ്വിസ്സ് ബാങ്കിലുമാണ്. സ്വിസ് ബാങ്കുകളില് ഇന്ത്യാക്കാര് നിക്ഷേപിച്ചിരിക്കുന്ന കള്ളപ്പണത്തെ കുറിച്ചുള്ള വിവരങ്ങള് സമയബന്ധിതമായി വെളിപ്പെടുത്താം എന്നു സ്വിറ്റ്സര്ലന്ഡ് സര്ക്കാരിന്റെ അന്താരാഷ്ട്ര ധനകാര്യ സെക്രട്ടറിയും ഇന്ത്യന് റെവന്യു സെക്രട്ടറി ശക്തികാന്ത ദാസും തമ്മില് ബേണില് വച്ചു നടന്ന കൂടിക്കാഴ്ചയില് തീരുമാനിച്ചിരുന്നു. കള്ളപ്പണം തിരിച്ചുനല്കാനും അക്കൗണ്ട് ഉടമകളുടെ പേരുവിവരങ്ങള് വെളിപ്പെടുത്താനും തയാറാണെന്ന് സ്വിസ്സ് ബാങ്ക് മേധാവി മിഥിയാസ് ബക്ക്മാന് മുന്പു പറഞ്ഞിരുന്നു. ഇനിവേണ്ടത് ഈ തുകയത്രയും എത്രയും പെട്ടെന്ന് രാജ്യത്ത് തിരിച്ചെത്തിക്കുന്നതിനുള്ള ആര്ജവമാണ്. ജനതയുടെ മഹാഭൂരിപക്ഷവും ദാരിദ്രരേഖയ്ക്കു താഴെ അരവയറുമായി ജീവിക്കേണ്ട ഗതികേട് ഒരു രാജ്യത്തിനും ഭൂഷണമല്ല. വിദേശബാങ്കുകളില് പെരുകുന്ന കള്ളപ്പണം പിടിച്ചെടുത്തു നാട്ടിലെ പട്ടിണിപ്പാവങ്ങളുടെ വിശപ്പെങ്കിലും മാറ്റാന് കഴിഞ്ഞാല് അതുതന്നെയാണ് ഒരു സര്ക്കാരിന്റെ വലിയ നേട്ടം. | |

കോൺഗ്രസ് നേതാക്കളുടെ വെല്ലുവിളിയും പരിഹാസവും നേരിടാൻ നരേന്ദ്രമോദി സർക്കാർ എന്തെങ്കിലും നടപടികൾ സ്വീകരിച്ചേക്കാം. പക്ഷേ, അതുകൊണ്ട് മാത്രം അവസാനിക്കുന്നതല്ല, യഥാർത്ഥപ്രശ്നവും രാജ്യം നേരിടുന്ന ദുരവസ്ഥയും. വിദേശത്ത് കള്ളപ്പണം നിക്ഷേപിച്ചവരുടെ പേരുകൾ പൂർണമായി പുറത്തുവിടുകയും വീണ്ടെടുക്കാൻ നടപടി സ്വീകരിക്കുകയുമാണ് വേണ്ടത്. ഇരട്ട നികുതി ഒഴിവാക്കാനുള്ള കരാറിനെക്കുറിച്ച് ബി.ജെ.പിക്ക് പിടികിട്ടുന്നത് അധികാരത്തിൽ കയറിക്കഴിഞ്ഞ ശേഷമാണെന്ന് കരുതാനാവില്ല. ഒരു ഒറ്റയടിപ്പാതയല്ല, ഇരട്ടനികുതി ഒഴിവാക്കാനുള്ള മാർഗം.
വിദേശ നിക്ഷേപം വൻതോതിൽ ആകർഷിക്കാൻ വേണ്ടി യൂറോപ്യൻ രാജ്യമായ അയർലൻഡ് 'ഡബിൾ ഐറിഷ്" എന്ന അതിവിചിത്രമായ മാർഗം സ്വീകരിച്ചിരിക്കുകയുണ്ടായി. ബഹുരാഷ്ട്ര കമ്പനികളെ നികുതി ബാദ്ധ്യതയിൽ നിന്ന് ഒഴിവാക്കാനായിരുന്നു ഈ ഏർപ്പാട്. ഇരട്ട നികുതി ഒഴിവാക്കാൻ ഇന്ത്യയ്ക്ക് അനുയോജ്യമായ പുതിയ ഒരു മാർഗം കണ്ടെത്താനാവും. കള്ളപ്പണവും ഇരട്ടനികുതിയും കൂട്ടിക്കുഴയ്ക്കേണ്ട ആവശ്യമുണ്ടെന്ന് തോന്നുന്നില്ല.
അഴിമതി, ഹവാല, പൂഴ്ത്തിവയ്പ്, കൊള്ളലാഭം, കള്ളക്കടത്ത് തുടങ്ങിയ സർവ്വ വിനകളും ശക്തമായും രാജ്യത്തിന് അതീവ ഹാനികരമായും നിലനിൽക്കുന്നത് കള്ളപ്പണം സുരക്ഷിതമായി നിക്ഷേപിക്കാനും ഉപയോഗിക്കാനുമുള്ള സൗകര്യം ലഭിക്കുന്നതിനാലാണ്. ഈ സൗകര്യം ലഭിക്കുന്നിടത്തോളം അഴിമതിക്കോ മറ്റ് വിനകൾക്കോ ശമനം വരുത്താനാവില്ല. നെറികെട്ട മാർഗങ്ങളിലൂടെ ധനം കുന്നുകൂട്ടിയതുകൊണ്ട് ഒരു പ്രയോജനവുമില്ലെന്ന ശക്തമായ സന്ദേശമാണ് കള്ളപ്പണക്കാർക്ക് നൽകേണ്ടത്. കള്ളപ്പണം കണ്ടെത്താനും കണ്ടുകെട്ടാനുമുള്ള പഴുതുകളില്ലാത്ത നിയമം നിർമ്മിച്ചാലേ അത് സാദ്ധ്യമാകൂ. അതിന് പകരം രാഷ്ട്രീയ ചക്കളത്തിപ്പോരാട്ടം നടത്തി ജനത്തെ കബളിപ്പിക്കാൻ ശ്രമിച്ചാൽ തനിയാവർത്തനമായി മാറും കേന്ദ്രഭരണം. oh aarum kondu varaanonnum pokunnillenne...ullathu povaathirunnaal athrem bhaagyam | |

| DRI, ED set to probe Adani Group for allegedly over-valuing power equipment imports

NEW DELHI: The oilseeds-to-ports Adani Group has come under the scanner of India's revenue intelligence agency as well as the Enforcement Directorate.
The Mumbai unit of the Directorate of Revenue Intelligence (DRI) has formally opened a case for alleged 'over-valuation' of capital equipment for power projects against the Gujarat-based group, widely regarded as close to Narendra Modi, BJP's prime ministerial candidate.
The agency is "investigating gross overvaluation of import of equipment and machinery by various entities of Adani Group from a UAE-based intermediary", according to an internal DRI report compiled in December.
ET spoke to multiple sources within the agencies and reviewed the report which claims that more than Rs 2,000 crore had been "siphoned off ". "An amount of Rs 2,322.75 crore has been siphoned off abroad by Adani Group by resorting to over-valuation of imports in the name of various group firms," the report says.
"The companies being investigated for over-valuation of imports are PMC Projects (India), Adani Enterprises Limited, Adani Renewable Energy, Adani Hazira Port Pvt Ltd, Adani International Container Terminal Pvt Ltd and Adani Vizag Coal Terminal Pvt ltd," says the report.
The Directorate of Revenue Intelligence has summoned Vinod Shantilal Adani as well two Dubai-based individuals, Mitesh Dani and Jatin Shah.
"The Adani Group and its firms have not declared the correct value of imports and a show-cause notice is being issued under Sections 111 and 113 of the Customs Act, 1962. All top officials, including the Adanis themselves, will be questioned," said a top DRI officer.
The Adani Group declined to respond to a detailed questionnaire. But a person close to the business house claimed it was the victim of a "witch-hunt" being conducted by the Congress-led UPA government against businessmen seen as close to Modi. "We are facing extraordinary harassment. Old cases are being opened up and notices are being sent on a daily basis. In the DRI matter, no formal notice has come so far," said the person close to the group. In November 2013, the Central Board of Excise & Customs (CBEC) had reminded the Directorate General of Foreign Trade, part of the commerce ministry, to cancel import duty benefits issued to the Adani Group in 2004.
These benefits — essentially the right to import at concessional rates — were issued under the Target Plus Scheme, an export incentive which has since been discontinued. The person close to the Adani Group referred to CBEC's reminder as an example of old cases being revived.A number of DRI officials strongly defended their investigation, claiming to have unearthed substantial evidence of what they referred to as "money-laundering" by way of over-valuation of imports.
They conceded, however, that the probe was being monitored at senior levels of the government. In July 2013, CBEC, under the finance ministry, had rejected a proposal from Adani Ports and Special Economic Zone Limited to install container scanners at its own cost for conducting customs operations at Mundra Port, India's largest private port which is promoted by the Adani Group.

The DRI report, which claims to explain the modus operandi followed by the group, claims that a Dubai-based entity was at the heart of the alleged over-invoicing." Various entities of Adani Group were indulging in gross over-valuation of imported goods (zero or low-duty rated) to siphon off money abroad. The modus operandi followed was that for power sector imports (power generation-0 per cent duty and power transmission-5 per cent basic customs duty) while the goods from various vendors (South Korea and China) are sent directly to India, the documents are routed through an intermediary created by them at Dubai, viz., Electrogen Infra FZE, which raised inflated invoices (inflating several times the original invoices of the Original Equipment Manufacturer) on the Indian company, against which money is remitted to Dubai.
From Dubai, while the actual invoice value is remitted to respective OEMs, the extra amount is routed to the Mauritius account of the parent company of Electrogen Infra FZE, i.e.- Electrogen Infra Holdings Pvt Ltd," according to DRI. "The activities of Electrogen Infra FZE are apparently controlled and managed by Vinod Shantilal Shah, alias Vinod Shantilal Adani, the eldest of the Adani brothers.
atin Shah, an ex-employee of the Adani Group stationed at Dubai, is known to be handling the dayto-day functioning of Electrogen Infra FZE with the help of two other Indian nationals, viz.-Mitesh Dani and Mehu Jani." According to agency officials, paper work generated against supply by Electrogen Infra FZE typically comprised the following two sets of documents. "Copy of the invoice raised by the Original Supplier-Original Equipment Manufacturer (OEM) in the name of Electrogen Infra FZE along with corresponding packing list and Bill of Lading. This set of documentation, which contains the actual price of the goods under supply, is not disclosed to authorities in India. These documents are routed/presented through banks having their overseas branch in the UAE, for facilitating negotiations between Electrogen Infra FZE and the respective OEMs."
"Copy of the back-to-back invoice/packing list (is) subsequently raised by Electrogen Infra FZE on one or more Adani Group entities together with the corresponding Bill of Lading thereof. This set of documents containing the inflated price is presented to Indian customs authorities on the strength of which goods are processed and clearance is allowed in India."
The report further said documents reflecting the actual value of goods supplied to India were provided by some of the banks with which Electrogen Infra FZE has had transactions: "Electrogen Infra FZE has utilised the services of Axis Bank, ICICI Bank and Bank of Baroda, all in Dubai.
Invoices reflecting the actual value of the goods supplied to India are available with the above banks, which have negotiated the transactions between Electrogen Infra FZE and the OEMs. State Bank of India and Standard Chartered Bank have also been utilised by Electrogen Infra FZE, to negotiate documents reflecting the actual value of the goods."DRI also claims to have decoded the ownership and shareholding pattern of the Dubai-based entity."
Based on the documents received from ICICI Bank (DIFC Dubai), in respect of the ownership and shareholding pattern of Electrogen Infra FZE, it was revealed that the firm is a wholly owned subsidy of Electrogen Infra Holdings, registered in Mauritius. Electrogen Infra Holdings Pvt Ltd is 100 per cent owned by Asankhya Resources Pvt Ltd, which in turn is owned by a firm named Eagle Holding Ltd, a nominee shareholder is Asankhya Resources Family Trust. As per documents, Vinod Shantilal Shah is the settler in Asankhya Resources Family Trust." | |
